FLEET RESCUE, LLC — TERMS OF SERVICE

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Fleet Rescue, LLC ("Fleet Rescue," "we," "us," or "our"), a California limited liability company operating at fleetrescueca.com.
By booking a service, submitting a form, or using our website, you agree to be bound by these Terms. If you do not agree, do not use our services.
2. Services Provided
Fleet Rescue provides mobile California Air Resources Board (CARB) Clean Truck Check emissions testing services, including:

OBD (On-Board Diagnostics) testing for diesel and alternative fuel vehicles with 2013 and newer model year engines

OVI (Opacity and Visual Inspection) testing for diesel vehicles with 2012 and older model year engines
-
Pre-test assessment (OBD vehicles only — must be requested at time of booking)

Free retest services as described in Section 6
All testing is performed by CARB-credentialed testers using CARB-approved equipment. Results are submitted directly to CARB's CTC-VIS system upon completion.
Fleet Rescue is a mobile service. We travel to your location — we do not operate a fixed testing facility.
3. Pricing
OBD Clean Truck Check:

2–5 vehicles: $129 per vehicle

6 or more vehicles: $99 per vehicle
OVI Opacity and Visual Inspection:

2–5 vehicles: $169 per vehicle

Pricing is based on vehicle count per appointment. Volume pricing is applied based on the total number of vehicles scheduled in a single appointment at a single location. Vehicles cannot be split across multiple appointments to achieve a lower per-vehicle rate.
Fleet Rescue reserves the right to update pricing with reasonable notice. Confirmed bookings will be honored at the price displayed at the time of booking.
4. Booking and Payment
4.1 Online Booking: Appointments may be booked online at fleetrescueca.com/book. A valid credit or debit card is required at booking for all primary service area appointments. Your card is not charged at the time of booking — it is held on file for payment on the day of service and for enforcement of the cancellation policy described in Section 5.
4.2 Payment Methods: Fleet Rescue accepts credit cards, debit cards, Apple Pay, Google Pay, PayPal, Venmo Business, cash, business check, and Zelle (available after April 8, 2026). Invoice and Net 30 terms are available for established fleet accounts by prior arrangement.
4.3 Payment Timing: For primary service area appointments, payment is due on the day of service. For out-of-area appointments, a 50% deposit is required at confirmation as described in Section 7.
4.4 Pre-Test Payment: For customers who have requested a free pre-test assessment, payment for the OBD Clean Truck Check must be received before the pre-test is performed. The pre-test is an included add-on to a paid OBD service — it is not a standalone service.
5. Cancellation, Rescheduling, and No-Show Policy
5.1 Primary Service Area Cancellations: Cancellations must be made at least 24 hours before the scheduled appointment. Cancellations made with 24 or more hours notice will not be charged.
5.2 No-Show and Late Cancellation: Fee A $75 fee will be charged to the card on file for:

No-shows (customer not present or vehicles not accessible at the scheduled time)
-
Cancellations made less than 24 hours before the scheduled appointment
This fee compensates Fleet Rescue for travel time, reserved time, and equipment preparation.
5.3 Out-of-Area Cancellations: Out-of-area appointments require 48 hours notice for cancellation. See Section 7 for out-of-area deposit and refund terms.
5.4 Fleet Rescue Cancellations: If Fleet Rescue must cancel or reschedule an appointment due to equipment failure, tester unavailability, or circumstances beyond our control, we will notify you as soon as possible and reschedule at no additional charge. No cancellation fee will be applied in this case.
5.5 Same-Day Appointments: Same-day appointments booked by phone are subject to the same cancellation and no-show policies. By requesting a same-day appointment, you acknowledge these terms.
6. Pre-Test and Free Retest Policy
6.1 Pre-Test Assessment: A free pre-test assessment is available for OBD-equipped vehicles (2013 and newer engines) only. The pre-test must be requested at the time of booking. It adds approximately 30 minutes to the appointment. Payment for the OBD Clean Truck Check is required before the pre-test is performed.
If your vehicle fails the pre-test, Fleet Rescue will return within 30 days at no additional charge to perform the official CARB submission once repairs are completed. The pre-test result does not constitute an official CARB submission.
6.2 Free Retest — OBD Vehicles: If your vehicle fails the official OBD Clean Truck Check, Fleet Rescue will perform one free retest within 30 days of the original failed test, provided the following conditions are met:

All OBD readiness monitors must show "Ready" or "Complete" before the retest can be performed

The vehicle must have been driven sufficiently after repairs to allow the OBD system to complete its self-checks

Fault codes must NOT be cleared and the battery must NOT be disconnected before the retest — doing so resets readiness monitors and may require additional drive time

The retest covers the same vehicle tested in the original paid appointment
-
One free retest per vehicle per original paid appointment
6.3 Free Retest — OVI Vehicles: If your vehicle fails the official OVI test, Fleet Rescue will perform one free retest within 30 days of the original failed test, provided the following conditions are met:

The vehicle must show measurable improvement in smoke opacity or repair of failed visual inspection items

No readiness monitor requirement applies to OVI retests
-
One free retest per vehicle per original paid appointment
6.4 Retest Scheduling: Free retests must be scheduled within the 30-day window from the original failed test date. Retests scheduled after 30 days will be charged at standard pricing. To schedule a retest, call (916) 847-3811.
7. Out-of-Area Service Terms
7.1 Out-of-Area Definition: Out-of-area service refers to appointments at locations beyond Fleet Rescue's primary service radius of approximately 2.5 hours one-way from Citrus Heights, CA.
7.2 Waitlist: Out-of-area customers may join the waitlist at fleetrescueca.com/waitlist. Fleet Rescue activates out-of-area service trips when a minimum of 10 vehicles are registered in a geographic cluster. Joining the waitlist does not guarantee service and imposes no obligation on either party.
7.3 Out-of-Area Deposit: When an out-of-area trip is activated and a customer confirms participation, a 50% deposit of the total service cost is required within 72 hours of notification. Failure to pay the deposit within 72 hours may result in removal from the trip.
7.4 Deposit Refund Policy:

Cancellations with 48 or more hours notice before the scheduled appointment: 100% deposit refund

Cancellations within 48 hours of the scheduled appointment: deposit is non-refundable
-
No-shows: deposit is non-refundable and the remaining balance may be pursued
8. Customer Responsibilities
To ensure a successful test appointment, customers are responsible for:
8.1 Vehicle Preparation — OBD Testing
-
Ensuring the check engine light (MIL) is OFF before testing. An active MIL results in an automatic fail and is not grounds for a free retest unless the underlying issue was repaired and monitors completed

NOT clearing fault codes or disconnecting the battery within a reasonable period before testing
-
Ensuring all OBD readiness monitors are complete before testing

Having the vehicle's VIN and registration information available
8.2 Vehicle Preparation — OVI Testing
-
Ensuring the vehicle's engine is warmed up before testing
-
Ensuring the vehicle and exhaust system are accessible for inspection
-
Having the vehicle's VIN and registration information available
8.3 Site Access
-
Providing safe and accessible access to all vehicles at the scheduled service location
-
Ensuring vehicles are present and available at the scheduled appointment time
-
Notifying Fleet Rescue of any access requirements (gate codes, security check-in, etc.) in advance
Failure to meet these responsibilities may result in a failed test or a no-show fee as described in Section 5.
9. Test Results and CARB Submission
Fleet Rescue submits all passing test results to CARB's CTC-VIS system in real time upon completion of testing. Customers can verify their compliance status in their CTC-VIS account.
Fleet Rescue is not responsible for:

CARB's processing time for compliance status updates
-
DMV registration hold clearance timelines (typically 24–48 hours after CARB submission)
-
Vehicles that fail testing due to pre-existing mechanical issues
-
CARB system outages or technical issues beyond our control
Fleet Rescue does not guarantee that a vehicle will pass the Clean Truck Check. Our service is to perform the test and submit results — not to guarantee compliance outcomes.
10. Limitation of Liability
Fleet Rescue's liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. Fleet Rescue is not liable for:

Indirect, incidental, or consequential damages

Lost profits or business interruption
-
Fines, penalties, or enforcement actions by CARB, DMV, or other agencies resulting from non-compliance
-
Damage to vehicles arising from normal testing procedures performed in accordance with CARB standards
Fleet Rescue carries $1,000,000 in general liability insurance. Evidence of insurance is available upon request.
11. Dispute Resolution
In the event of a dispute, you agree to first contact Fleet Rescue directly at (916) 847-3811 to attempt resolution in good faith. If resolution cannot be reached, disputes shall be resolved through binding arbitration in Sacramento County, California, in accordance with the American Arbitration Association rules. California law governs these Terms.
12. Modifications to Terms
Fleet Rescue reserves the right to update these Terms at any time. Updated Terms will be posted at fleetrescueca.com/terms with a revised date. Continued use of our services after changes constitutes acceptance of the updated Terms. Bookings confirmed before a Terms update are governed by the Terms in effect at the time of booking.
